Terms and Conditions

This Agreement sets forth the terms and conditions between Tours and Travels Amsterdam and users who use our services to purchase tours and travel services (“You”) from individuals who provide tours and travel related services (“Tour Guides”). This Agreement explains how you purchase tours and travel services and specifically limits the liability of Tours and Travels Amsterdam.
You must read this Agreement before using the Site and booking a Tour. Use of the Site constitutes an agreement to all terms and conditions in this Agreement and you warrant that you understand, agree to and accept all terms and conditions contained here.

Covid19

Tours and Travels Amsterdam adheres strictly to local and national rules and regulations regarding Covid19 and other health regulations. Under no circumstance can Tours and Travels Amsterdam be held liable for participants of our tours breaking local and/or national regulations. In other words, participants of our tours remain solely responsible at all times to know and abide by local laws and regulations. In case any rules or regulations are broken by other participants of the tour, Tours and Travels Amsterdam cannot be held responsible, accountable or liable for any damages resulting thereof. In case you think you might have contracted Covid19 or any other disease during one or our tours, Tours and Travels Amsterdam cannot be held accountable, nor do we assume or accept liability for any type of behavior of other participants on any of our tours.

General

You understand that the Tour Guides presented on the Site are independent contractors and that the Tour Guides are not employees or agents of Tours and Travels Amsterdam. You hereby understand and expressly agree that Tours and Travels Amsterdam does not control the quality, timing, legality or any other aspect whatsoever of the services actually delivered by the Tour Guides, nor of the integrity, responsibility or any of the actions whatsoever of the Tour Guides.

Tours and Travels Amsterdam uses its best efforts to monitor Tour Guide profiles, service offerings, actions and comments, and suspend privileges to any Tour Guide not adhering to policies of Tours and Travels Amsterdam. By using this Site, you agree to report any alleged improprieties of any Tour Guides to Tours and Travels Amsterdam.

Prohibited Use

The Site may not be used to recruit, solicit, or contact Tour Guides for employment or contracting for a business not affiliated with Tours and Travels Amsterdam unless you first obtain express written permission from Tours and Travels Amsterdam

Cancellations

Our tour guides are entitled to cancel or change the date of an event. Should this happen, Tours and Travels Amsterdam will attempt to provide a suitable solution. If an event is cancelled or postponed, Tours and Travels Amsterdam will do its utmost to inform you as soon as possible. However, Tours and Travels Amsterdam cannot guarantee it is possible to inform you timely of any change or cancellation of an event or be held responsible for refunds, compensations or for any resulting costs you may incur, for example for travel, accommodation and/or any other related goods or service.

Prices/offers

All offers made by Tours and Travels Amsterdam are without obligation and Tours and Travels Amsterdam expressly reserves the right to change the prices, in particular if this is necessary as a result of statutory or other regulations.
All prices are indicated in euros, including VAT.
In certain cases, promotional prices apply. These prices are valid during a specific period as long as stocks last. No entitlement to these prices may be invoked before or after the specific period.
Tours and Travels Amsterdam cannot be held to any price indications that are clearly incorrect, for example as a result of obvious typesetting or printing errors. No rights may be derived from incorrect price information.

Payments

Tours and Travels Amsterdam accepts a number of different payment methods. It is also possible to pay with cash before the start of the tour.

Intellectual Property Rights
All content found on the website and social media such as designs, photographs, images, sounds, the brands look and feel, videos, music, data, typefaces is owned by Tours and Travels Amsterdam. This all falls under “Proprietary Material” and is protected. You are prohibited to make use of any of the above without prior written permission.

Any content you upload to the website (e.g. reviews, photos etc.) automatically falls into ownership of Tours and Travels Amsterdam and may be used on our social media channels, for marketing purposes or other documentation.

Tours and Travels Amsterdam shall not be liable for damage, misuse or loss.

Tours and Travels Amsterdam is not liable for any misunderstandings, distortions, delays or incorrect transmission of data and messages as a result of the use of the internet or any other communication resource in the traffic between the customer and Tours and Travels Amsterdam (or the parties deployed by the customer).
The records of Tours and Travels Amsterdam will serve as full evidence of the existence, the content and the implementation of the agreement with the customer in any legal procedure, subject to counter-evidence provided by the party that invokes the fact that the evidence is unreliable.

Notice of Trademark Rights

The service marks and trademarks Tours and Travels Amsterdam and the Tours and Travels Amsterdam logo are service marks owned by Tours and Travels Amsterdam. Any other trademarks, service marks, logos and/or trade names appearing on the Site are the property of their respective owners. You may not copy or use any of these marks, logos or trade names without the prior written permission of Tours and Travels Amsterdam or the applicable owner.
